These Terms and Conditions govern your use of ernestwaddell.com and the purchase of any products or services offered through this website, including but not limited to fine art photography prints, merchandise, digital content, and visual art. By accessing this site or placing an order, you agree to be bound by these terms.

This site is operated by Ernest Creates, a sole proprietorship based in Los Angeles, California, owned and operated by Ernest Waddell.

2. Products and Services

2a. Fine Art Photography Prints

All photography prints sold on this site are produced to the highest professional standard. Each print is individually reviewed before shipment. Due to the nature of fine art printing, slight variations in color may occur between digital previews and physical prints. These variations are inherent to the printing process and do not constitute a defect.

Prints are available in limited editions unless otherwise stated. Edition size and numbering will be noted on the product listing.

2b. Merchandise

Merchandise items including apparel, accessories, and other goods are produced on demand through third-party fulfillment partners. Production typically takes 3-7 business days before shipping.

2c. Digital Content

Digital downloads, film content, and other digital products are delivered electronically. All sales of digital content are final. Once access has been granted or a file has been downloaded, no refunds will be issued.

2d. Visual Art and Original Works

Original works and limited edition pieces are sold as described in individual listings. All sales of original works are final. Provenance documentation will be provided upon request.

3. Pricing and Payment

All prices are listed in US Dollars (USD) unless otherwise stated. We accept the following payment methods:

Credit and debit cards via Stripe
PayPal
Cryptocurrency via NOWPayments (Bitcoin, Ethereum, and other supported coins)

Cryptocurrency payments are processed at the exchange rate at the time of transaction. Prices are subject to change without notice. Your order total will be confirmed before payment is processed.

4. Shipping and Delivery

Physical products are shipped to the address provided at checkout. We are not responsible for delays caused by carriers, customs, or incorrect shipping information provided by the customer.

Estimated delivery times:

Domestic (US): 5-10 business days
International: 10-21 business days

International orders may be subject to customs duties and taxes upon arrival. These charges are the responsibility of the buyer.

Once an order has shipped, tracking information will be provided via email. Ernest Creates is not responsible for lost or stolen packages once confirmed delivered by the carrier.

5. Returns and Refunds

5a. Fine Art Prints

Due to the custom nature of fine art prints, all sales are final unless the item arrives damaged or defective. If your order arrives damaged, please contact us within 7 days of delivery with photographic evidence and we will arrange a replacement or refund at our discretion.

5b. Merchandise

Merchandise may be returned within 14 days of delivery if it arrives defective or incorrect. Items must be unworn, unwashed, and in original condition. Return shipping costs are the responsibility of the buyer unless the return is due to our error.

5c. Digital Products

All sales of digital products are final. No refunds will be issued once digital content has been accessed or downloaded.

5d. Original Works

All sales of original works are final.

6. Intellectual Property and Prohibition on Reproduction

All content on this website including photographs, films, artwork, text, and design elements are the exclusive property of Ernest Creates (Ernest Waddell) and are protected by United States and international copyright law. All rights reserved.

Purchase of any product, print, or digital content from this site does NOT transfer any intellectual property rights, licenses, or ownership to the buyer. You are purchasing a physical or digital object only — not the right to reproduce, copy, or use the underlying work in any way.

Without express written permission from Ernest Creates, you may NOT:

Reproduce, copy, scan, photograph, or digitize any work purchased or viewed on this site
Distribute, share, upload, or transmit any work in any medium, including social media, websites, or digital platforms

Cryptocurrency payments are processed through NOWPayments. By choosing to pay with cryptocurrency you acknowledge that:
